Divorce is the legal dissolution of the marriage: in order to get divorced, a couple normally has to separate their finances, make arrangements for child support and visitation, etc... it's pretty complicated. Getting separated is easy, by comparison -- you just go rent a place and move your stuff.
  • Legal separation occurs when you file for separation with the court. In many states you must be separated for a certain amount of time (usually six months) before a divorce can be ordered. Although this varies by state, once you are separated, certain property is no longer treated as marital property. But again, the exact ramifications of separation vary widely by state.
