Wednesday, June 18, 2008 (UPI) - An appeal will be filed in a Montreal court after a Quebec judge overruled a father who grounded his 12-year-old daughter for dangerous Internet use. The lawyer for the father, who can't be identified to protect the girl, told The Gazette newspaper that Justice Suzanne Tessier overstepped the court's bounds last Friday when she ruled in favor of the girl's legal challenge and said she would be allowed to go on a school trip her father had forbidden because of misbehavior. "I don't think this tribunal was the proper forum for a decision like this one," lawyer Kim Beaudoin said. "If we don't learn at the age of 12 there are rules to follow, when do we?" He said he was preparing an appeal based on the fact the judge acknowledged the girl's repeated defiance of her father's house rules. They included bypassing security settings to block Web sites the father didn't trust, then using a friend's computer to access those sites. Beaudoin said the girl also posted online photos of herself "inappropriate for a child her age," the report said.

  • Just another example of governmental interference in the home. If the government thinks they can do a better job, perhaps they should take them from the moment of first rebellion, feed them, clothe them, educate them, discipline them, protect them from predators, and then return them when they are of legal age to assume responsibility for their own actions. Guess the only thing the children will miss is the love from a parent that gives the hard lessons because we care.
  • According to Myspace's terms and conditions agreement, no person under the age of 14 can be a user on that site. If that's the case, then this 12 year-old girl shouldn't be using that site in the first place. She has no legal rights to be on that site. Besides, this is a matter that should be handled in the home, and the judge definitely overstepped his bounds with this ruling.

  • Something doesn't add up here, especially since 12 year old cannot legally have a Myspace page, so I dug a little deeper. Apparently there's more to the story, but unfortunately it's ever more ridiculous. The Father and Mother of the girl are divorced, and the girl got into a spat with her step-Mother while living with her Father. The Father has custody, mind you. Anyways, so the Mother sued the Father on behalf of the daughter, scored this bat-shit crazy judge (Justice Suzanne Tessier), and she somehow agreed to take this most ridiculous of cases and ruled against the Father because - even though he has custody - the daughter is living with the Mother and "a field trip is a big deal" the judge over-ruled the Father. There really must be not much going on in in Quebec for them to take this case. This shit wouldn't fly in the US. You occasionally hear about some stupid random cases, but 99.9% of them get thrown out. This one will, very regrettably, be taken to another court and overruled. It's regrettable because it's going to another court, not that it'll be overruled.

  • I saw something about this in the Journal de Montréal, but didn`t pay too close attention. Québec is a dying society with little time left. It will cease to exist sometime in my lifetime. It is being propped up by government involvement and immigration. Nothing that goes on in this province should surprise anyone.

  • The judge, I presume is quite liberal? And clearly aiding the degradation of Montreal's society. She should be admonished at the very least, if not unseated. It is a shame that this will set a legal precedence. No matter how small or stupid it may seem... Any precedence is a foothold for the next ridiculous legal action. As far as the little girl in the case goes??? If my 12 year old daughter pulled some garbage like that, she'd be living the monestary life for at least a year in my house. She'd be begging to move in with her shit disturbing mother within the first week... And I'd let her - if her mom is going to teach her to act this way (and support it by arranging the legal) - then she'll have to live with the disobedience she is sponsoring. It should be lovely when she turns 16 and wants to use the car.

  • I think it's a waste of taxpayer's money and an abuse of the court system. As long as the punishment is not degrading or abusive, and having to miss a field trip is neither, parents have the right to impose whatever consequence they see fit. Shame on the judge who set a dangerous precedent for childrearing everywhere...
  • Fortunately, this has a couple more levels to go to before it's final. However, Canada's laws and judges are, on the whole, more lenient than those of the U.S., esp. with children. I'm not surprised. I do think it's wrong.

  • nice to know our taxpayer dollars are being put to good use. while she's tieing up the court system, my taxes are paying for some rapist or murderer to sit in jail while waiting for trial.. give it 10 years and all the kids will be suing parents for any sort of discipline they might get.
