  • He is. It's in his yard. UNLESS the branch was hanging over your yard. If the branch was hanging over his property line, it's his responsibility. He had the right to cut it down if he wanted to. Since he didn't, he has to deal with it.
  • I talked to a lawyer about that specific issue. He said that while your neighbors have the right to trim or cut down any branches from your tree that extend over their property those branches are ultimately your responsibility.
  • Although I am not here to judge the other answers you really need to contact the law in your area because it varies from state to state. What I would do is: Go to the neighbor and discuss what options there are. Having neighbors does not have to mean what is mine is mine and whats yours is yours. Getting along and putting your heads together to work out the best possible solution works far better then taking ot giving blame.
  • Your best bet is to work it out with yor neighbor. Perhaps offer to split the cost. The legal answer depends on who was negligent, if anybody. If nobody was negligent causing the limb to fall, then nobody is liable to anybody else. Thus, if your neighbor wants it removed he is responsible. Of course, unless there was a stromg storm that caused the limb to break, an argument can be made that you were negligent by not caring for the tree, thus making you liable. But more facts would be needed to decide this.
