Take him to court. Depending on what state you're in you should be able to get a judgment based on what your children's needs are. The courts have ways of ensuring those payments get made, by garnishing paychecks or seizing assets. Seek out an attorney, there should be some listings in the phone book for free legal consultations for divorce cases.

My ex-husband did the same thing. And my best advice is continue to go to court and get support enforced! He will owe you back support, that never goes away. He eventually HAS to make money and you WILL get it. Maybe not now, when you need it most, but you WILL get it. He can't file it in bankruptcy, no court will wipe it clean later because the kids are older. He will FOREVER owe you that money. PS... my ex eventually found a minimum wage part time job that he tried to take to the court as the best he could do. The judge saw right through it. They matched my salary and work week (40 hours) and told him to get off his lazy ass and get a real job if he couldn't afford to pay his child support. Today they are taking ALL of his paycheck from the PT job to pay me first AND he will owe me back support for SIX years, after she turns 19. It's not much, it comes in a little bit at a time, but he WILL be paying me back!!! Good luck to you!

He is free to go out of business. You will have to keep too records and know when he begins to earn money again.
