If so, and your daughter is okay with it, go ahead. I know how you feel about the owed C.S., (my dad NEVER paid a penny). But, if yall really want to do this, just go ahead.
  • There is no legal correlation between the child's name and the father's duty to pay child support. Are you concerned that such an action would make your ex stop paying? If your current husband adopts your daughter, that would terminate the father's duty to pay child support. However, if you have legal custody, you can change the child's name without an adoption.
  • Hi I also live in NC and have a child that my husband and i wanted to change the last name to our last name. this is the steeps we took go to the court house at the clerk of courts or records and ask for a change of name petion it cost around 50 dollars you do not need a attorney fill out the form and return it and it will be filled with a judge and go to raleigh and you will get a new social security card in the mail around three months later the only catch is you need the biological father to agree to the change of name and this does not mean your husband needs to adopt her it just means her last name can be changed and she will still get her child support the paper you fill out will explain everything to you good luck .
