  • I used to work for an insurance company that handled disability claims, so I will try to answer this to the best of my ability. Disability coverage through your employer usually ONLY entitles you to a certain number of days of pay after the birth of the child, but it can also depend on what your doctor states if you end up having complications before or during the delivery. However, just because you are claiming disability does NOT mean your job is protected, and unless the doctor states otherwise, you normally have to work right up until your due date. Normally the employer will not fire you for the days that you are out on the claim, but to be on the safe side, you should always be placed on maternity leave at the same time. You could try speaking with a lawyer, but if you were terminated even before the baby was born, you wouldn't have much of a case.
