  • Yes..Unless you signed the birth certificate as the father..then its iffy..alot of judges will not go back after the bio father because you were the one that decided to take the responsibility and then waited 10 yrs to ask for the bio dad for support

  • I'm pretty sure DreAnna is right about you getting a hard time if your name is on the birth certificate. Also, if you have legally adopted the child at any time between then and now, which is what happened to me. Otherwise, the DNA father is still responsible.
  • If the two of you were married when the child was born then the child is presumed to be yours. You can request a paternity test so that your name will be taken off the child's birth certificate. How old is the child? Does the father have anything to do with the child? Do you plan on adopting the child and raising it as your own? All these things influence whether or not it's a good idea to file for child support from the biological father.
  • The question you need to be asking yourself is do you want this little girl to know that you are not her father? If you want the wife of this man to know of the affair then tell her. Don't try to drag the man into court through you wife under the guise of wanting child support just to expose the affair.
