  • Well, it's an established fact that operating your cell phone - even "hands free" - increases the likelihood of having an accident. However, I think it would be the police who would need this information to determine the cause of the accident. Your insurance company pays for your damages no matter what - but I guess it would help them determine whether or not to go after the other person's insurance company (in a two-car accident) or not. Anyhoooo, my answer would be that it is OK for the police to check this information, and provide it to the insurance company only upon request; but not for the insurer to instigate this inquiry.
  • It would depend on your insurance- does it say on there that if they insure you, they have the right to do so? Especially if they're up-front about it, it makes sense to me. On the other hand, if there was no such clause in the coverage, I would probably fight it as an invasion of privacy.
  • lol...lol .. they could try but if it wasn't a clause in my insurance or illegal in the state I lived ...well I would have their arses in court so fast their heads would spin... :)
