  • It is legal for local and state law enforcement to get "taps" - they have to have a warrant if the phone calls do/could reasonably cross state lines, the feds have the jurisdiction - it is completely within the law to get a warrant to listen in if there is enough proof or if the phone call comes in or goes to a known terrorist number
  • yes like someguy said. if they do it without warrant then the taps and any results from the illegal taps more than likely be thrown out of court and the suspected criminal gets off scott free and percentage for that would be 99.9% that be thrown from court because if court try to prosecute then it can go to mistrial they do not have the right to break the law to enforce the law. even tho it is hollywood dramatization watch some of the CSI shows they almost always waiting on warrants and it hinges on that a lot.
