  • i am disabled and cannot go to house or care for dog. husband works alot, but was there as often as possible. 8&9 year old only went alone once. Need to know what my responsibilty is. getting phone calls night and day threatening with police. their 17 year old son is screaming and threatening from property line. i am scared but broke from medical bills and don't know what to do. if they had call calmly husband would have tried compound but they won't let us see the car.
  • NC has a vicarious liability statute that makes the parent liable for their child's negligence (this is not true in all states). Therefore, if your daughter is liable for the damage, so are you. So is she liable? Well, more info is needed. Do you know if the damage was done by your daughter or the friend? If so, how was it done? Since your daughter was hired (as opposed to you), the standard of care that is required is that of an 8 year old child. Thus, if damage occurred accidentally, you have to evaluate whether the accident was unreasonable giving the age of your daughter. If the actions were intentional, then you are liable for the damage in the house. As for any damage outside, you are only liable if your daughter caused it.
