Our HOA in still governed by the builder.The covenant says they will not restrict the right of the owners to sell.They just made a new policy stating for sale signs are not allowed in the turf areas.That now violates the covenant.What recourse do we have?

Making restrictions on where you can place signs, does not restrict your right to sell. Buy the biggest sign you can, and place it in your front window. Better yet, take white shoe polish and give them a good ole redneck "4-sale" sign all the way across your biggest window.

What I meant was the new policy violates the covenant that new rules must be approved by 51% of homeowners. No vote was taken. Isn't this a violation?

Granted, it's been quite some time since I had anything to do with a HOA, but the last time I had anything to do with a HOA, there were property owners who were members of that association. Check the by-laws for this provision: Are (Sale) signs permitted to be displayed on trees, rocks and in windows of the properties being offered for sale?
