  • The answer to this question depends upon whether or not you are LEGALLY separated and the laws of property distribution in your jurisdicition. California is a community property state, basically anything aquired during the marriage is divided equally (or roughly so). Legal separation is something you file for and a judge grants, so if you don't know whether or not you are legally separated, you are not. So long as you do not buy the house with community property, you SHOULD be safe; however, there is always the argument that your salary is community property (marital property) until you are legally divorced. (my soon to be ex husband's lawyer is trying that on me) To completely be safe, you should divorce first.
