  • Depends on how lease was written if they signed a lease. If no lease was signed they are tenants at will and can leave without penalty at anytime. Usually with a signed lease, the tenants usually forfeit their last months rent and security deposit. Advertising is the owner responsibility. This I know is the law in MA. and many other states.
  • As the homeowner, you need to be sure your interests are protected. However, I have found it is better to just let the tenants go, with as little hassle as possible. It can become an expensive, long, drawn out battle in the courts, or you can save yourself a lot of trouble, write off the loss and get on with your plans. In my experience, trying to get tenants to do the right thing is a hopeless task.
