Both my daughter and her husband owe back child support. If they file a joint return, who gets the refund? Will it all go to his back payments, or will it be split between the two as it should be? I was told his case would get it all. Need confirmation.

They just cleaned out my ex's bank account, and they will be taking his refund and rebate checks. Your daughter and husband shouldnt get a dime of it, they should pay there child support.

it would be nice if people would read the question as asked and not put their own interpretation to it. No where did I say that they were not paying their child support. My question involved a tax problem. My daughter would like her refund to go to her children, not her husband's. She was told if they filed jointly, his children would get all the refund as he owes a little more than she does. that doesn't seem right to me or her. If she files separately, she loses the Earned Income Credit and the children lose out too. I need an answer to my question, not midjudgments and misinterpretaions. Thank you.

more than likely it will depend on whose garnishment hit the system FIRST. so if his DA filed the lien first, then it will will go to his. and vice versa. hope this helps!
