  • Legal custody of a child has absolutely nothing to do with the name on the birth certificate. You get a lawyer, or family court advocate, and get a legal court order, giving you custody of the child, and go. He has no legal way to prevent you from moving where you want.

I have been in the same situtation, I was a single mom for a long time. If the father wants to be in his childs life then I do not think you should take that away from either your child or the father. So many children grow up w/o parents, and it is alot harder than one may think. If he is willing and wanting to parent, let him, don't do it alone. Good luck

  • It was not a bad thing that his name is on the birth certificate. A child needs to know who his parents are. So many do not and that is a worry. However, on the moving thing: get legal advice. If he is not paying child support, and you need to move in order to live and provide for the child, then the courts may work in your favour.

If you are not married to someone you have a kid with no matter if they are on the birth certificate or not, automatically the mother has soul custody and if he want any kind of rights, including not letting you leave the state he must first go have his right ligitmated(i dont think i spelled that right). But yeah unless you are married you have full cutsody. Even if he is paying child suppot.
  • You can move as long as he can see the baby when ever he wants if he takes you to court...and add that he can not take the baby out of the state in which you can..as long as your willing to let the dad see the baby WHEN ever he wants and if he comes n sees the baby good but if not then the court will see that he dont even vist so he permission is not need but IMPORTANT you attach that and if you havent been to court for vists then your free to do what you want. been there done that
