  • No, not unless you are performing some job-related service, while on your lunch break. This does not apply to the police, since we are on duty 24/7, lunch break or not.
  • If you are paid for your lunch break..as in "still on the clock" its possible..otherwise..no you cannot collect workmans comp.
  • Only if you spent your lunch break working on something for that company, at the orders of your supervisor. If you were doing something for them, but doing it on your own initiative, during your lunch, then you would not be compensated. Nor would you if you were just going to or from lunch. To get worker's comp, you must be doing a job assigned to you, or on the premises, on the clock. Even if you are just on the premises, even inside, and not working, you cannot get worker's comp. Their insurance may pay, but not comp.
