If you are married but live in different states - then you could send the papers and disapear yourself - so that she could not find you - but i think you are stuck and need to stand on two legs.

It also depends on what your marriage is like now. If she ran off with some guy to live in Siberia ten years ago and you haven't seen her since - you could probably pull it off. Good luck.

Even if you could, what would you do-- continue living with her? After so many years, even a common-law wife would have entitlement to a portion of your estate. But in your case, both parties have to agree to the divorce. She would have to be served divorce papers. You may have secrets from her, but the divorce won't be one of them.

The question shouldn't be how can you divorce your wife without her knowing. The question should be why would you want to? Not why would you divorce her but why wouldn't you want her to know it if you did?

In all the rest, the division of property is up to the lawyers and the courts. By the way, even if you get a divorce without her knowledge, the laws regarding the division of property still don't change. When my son's wife ran off and left him while he was on an aircraft carrier in the Persian Gulf, she left no forwarding address. He came home and followed the instructions on how to divorce an absent spouse. You can figure this out, if you need to, just like he did.
