  • If the County Attorney allows her to drop the charges, then nothing will happen. If not, then she may be subpeonaed to testify against him, if she refuses to do so, then the Commonwealth may proceed without her by using the report from the officer and the evidence collected (ie photographs at the scene, his statement, her statement, and/or anything else that was collected). Most times the prosecution will not fare well without the victim cooperating, so the most likely course of action would be for the County Attorney to drop the case.
