The phrase "dog pen" covers a wide range of structures, from a tiny enclosure which it would definitely be brutal to put a human into, to a large outdoor cage similar to many prisoner enclosures which may once have been used for dogs. One would have to know how big the enclosure was, what the weather was, what shelter was available etc. Obviously, there should he proper accommodation for prisoners, and many so-called dog pens would not be suitable. But some might, particularly in unexpected circumstances: we would need much more information than a shorthand name to make a proper judgement.
