Chances are because you are the mother you will be awarded full custody, but I do not think it would be fair to your son to have him move so far away from his father especially if he is involved in his life, I think you need to talk to his father and your son and see what they think about it, unless the father is a threat to the son it would be unhealthy to ruin that relationship

More than likely you will be granted full-custody of the child if taken to court. When you file a custody petition, notification will be sent to the person him being the father. The father will be granted an attorney as well as yourself if you cannot afford one.The child will be granted an attorney called a law guardian. The child will be interviewed. The law guardian serve as a child advocate. Sometimes, when there's a petition for custody the judge will order children services to investigate both parents to ensure that the child's basic needs are being met. If you decide to go to court and you're awarded custody of the child, the father will be entitled to visitation rights. The judge will for a plan to be developed wher the child can visit with his father. i.e. child spending holidays such as summer vacations with his father. A custody proceeding can last months... If you decide not to go to court. Speak to the father and try to make arrangments so that he can see his son. I suggest that you put everything in writing and have it notorized. The legal way is the right way to go to avoid breaking any laws.
