Yes, he would probably be fired, but that is up to the employer. Is it legal? Maybe, but probably not. New York State does recognize transgender rights under its human rights law. The problem, however, is that it is unclear as to what exactly is protected. Transgender defines many different things. People who truly identify with the opposite of their biological sex are probably protected. Mere cross-dressers are probably not. The fact that you want to change mid-employment will probably hurt you.
