  • Not necessarily. unfit parents, etc, drug addicts, ex-convicts are very unlikely to gain custody of their children. they cannot be trusted. the courts really frown on unfit parents. the child comes first, period. how old is your husbands daughter? If you do not have an attorney, you need one just in case. better to be prepared, than have a stranger knock on your door seeking to retrieve her child. There could be major trouble.
  • How old is the child? I believe if she has been with you for such a long time, and mommy dearest has not even sought visitation, or paid a cent, I wouldnt worry about what the child wants at this time. Children are not able to make that decision till they are at least 13, but in your case, regardless, Mom obviously doesnt want her, which is sad, but just do whats best for the child. She will thrive and flourish being with you and hubby.
  • I see, and the reason she probably wants to stay with Mom, is there are not boundaries, or structure which a child and teen require. I am sure Mom is not the ideal role model for a 15 year old impressionable girl. Simply say NO, and explain you both love her, want her to finish school, and will do what is best for her. Also explain when she is 18 she can make the choices on her own. Mom will end up in jail again anyway for non payment of child support.

  • 'WE have had custody?' Is your name on any legal document saying that you, the non-parent, share custody with the father? Your husband needs to consult a lawyer ASAP. Yes, I realise that this question is old, but other folks will encounter this same situation, so I commented on the general question, not to the specific person.
