I'm assuming that this is a rhetorical question. In the states, it is not considered rape if you have consensual sex with your wife, regardless of her age. Unfortunately, some child abusers escape the consequences of the law by marrying their victims.

I am under the impression, that if you cross state lines (or further lol), to obtain sex from a minor, it turns into a federal offense, not just a sexual offense, as if you did it in a state you lived in. This is just my opinion based on information given from other legal sites.

In some states the age difference between the participants is the criterion for deciding whether a minor can legally "consent" to have sex.
