What do you mean, "who is not around anymore?" Makes a difference on why is not around. Is he deceased? That would be different than if he went to New Zeland and is never coming back and he owes you money.

Where are you located? What type of car? how old is the car? Is he deceased or just left? Is there a lien on the title?

If he is just living elswhere, have him give you power-of-attorney for the vehicle so that you can legally sell it in his name. Power-of attorney paperwork should be easily found online. If he is deceased, contact your local Department of Motor Vehicles (or whatever it is called in your area). They can tell you how to get the title transferred to you so that you can sell it.

Just sign his name.

Eaither sign his name or if its a death then you'll need to give the buys a death certificate.

If he can't or won't ever dispute the sale, you can simply sign his name. It easier than the red tape involved in getting the rights signed over legally. Not to mention the possibles taxes due with each transfer of the car's owner.
