  • He might not be using his vacation days for his time off, he might be just calling out with no pay. Any regular absences from work are annoying.
  • Employment laws are a state or provincial matter, generally, so they can vary. But they can't fire you for using a legally mandated benefit such as vacation days. Usually, you have to negotiate time off, not just take off a day here and there with no warning. Did this happen to your colleague? He should have booked it off in advance, with the agreement of his manager.
  • Any time you are unavailable for work and you are needed, and it creates a hardship for your employer, they have a right to let you go. If he is legitimately taking his vacation days for the time he's missing, that's one thing.
