  • It might be illegal because she isnt authorized to look at company emails. The company and your boss have the right to both monitor and read what you're sending and receiving. But if you're like me, you probably thought that the ISP you use at home--and by extension those who work there--doesn't have the same right. We're wrong: they do. At least that's what a recent court ruling says. Apparently, a strict reading of the laws that supposedly protect our private communications--principally 1968's Wiretap Act (Chapter 119 of Title 18) and one of the subsequent amendments to it, 1986's Electronic Communications Privacy Act--in effect denies e-mail the kind of privacy protection from law enforcement agents that other forms of personal communication have.   • it depends if the company knows about it. It may just be against company policy and the person who did this may be in trouble her terminated but emails in an office are never private and often subject for review.

  • If she's using company resources for her email and the aforementioned recipient is authorized to monitor it then it's legal. Although I don't know whether this applies to your wife's situation, even if the email messages contain personal info it's still legal because the company is allowed to restrict the usage of their resources, therefore they can monitor whatever communication is there.
  • Similar question - one employee read another's emails, they concerned him and his many recent errors and unflatteringly criticized his known character flaws -lying,manipulating, blaming others. These are documented facets of his work, known to many. He somehow got access to the email of another and printed out these emails -to what end we don't know yet. But that he got them that way in the first place should poison the fruits of his endeavor, no ? He had no right to access this person's email - he is not authorized to monitor, nor have access to other's email. Would you say what he did was worse than what was possibly said about him ?

  • Bottom line.... If its a company computer, emails are not private. Computers belong to the company and not the worker. In my job, everything is recorded. phone calls, emails, even checking on a persons criminal history is recorded. I realize its a liability issue for government and private industry. this does not bother me.
  • Its illegal if that person doesn’t have the authorization to read/re-route other peoples email... but its up to the company to handle since its a company email account. She should take it to her supervisor.
