  • Yes, if it wasn't consumated it is grounds for an annulment.
  • Whether or not he can get an annulment is based upon the laws in the jurisdiction. There is often a time-period for this, as well (unless the marriage was illegal to begin with - bigamy, etc). On the grounds that the marriage was never consummated, he has a good shot, but there is also the consideration that - being imprisioned - they married accepting that the marriage would not be consummated for quite some time.
  • Whether or not the marriage was consummated is irrelevant in most, if not all, states. Annulment laws vary by state, but usually it is only available for acts of fraud (or the like). Also, many states only allow annulment within one year.
  • Un consummation is one of the main grounds for annulment.
  • Depends on the state. But in most states, any child born in a marriage belongs to the father as to support. Won't matter if DNA proves otherwise. That factor may prevent annulment, but not a divorce. Being he's in prison, she has better prospects of having the true father support the child.
  • Bummer! Here I am a free man. I have life insurance that will pay $1.15 Million only to a spouse or children under 23 if in college, otherwise 18. And I can't even find someone to marry and feed me poisoned mushrooms. I'm really jealous though. I can't find anyone and yet someone is prison does. Does that mean I might actually meet someone if I commit a crime? I mean I understand Charlie Manson gets about 50 proposals a year. And I'm better looking than him. I believe richer. I know I have a better home. No doubt I am a reject, but really don't understand why.
  • Wait, wait. I re-read that. Son in prison, wife married in prison. Does that mean the wife is also in prison? Did they meet at the weekly shrimp fry and dance. And is she running around with a guard that got her pregnant? Gee, prison is really sounding like fun. I even heard of couples proposing though the toilet-com. How romantic. "Flush three times if you love me, take a dump if you don't!
