  • Probably send you to jail, make you pay fines (by far exceeding what you stole) I knew a guy who stole a t-shirt and had to pay nearly $1000 in fines. He was only 14. Also you WILL be banned from the store. no doubt about it. They do frown on things like that.

You will not be able to work at any government job. once your background is checked, the shoplifting charge will deny your employment. First offense, will probably get you probation and court costs. This is only menial, compared to your future employments. I assume you were arrested?

  • Less than $500 is only a misdameanor! If you have a lawyer, you need to ask the lawyer to get you a SIS probation. This probabtion means that the offense will stay on your record. However, if you walk down your probation without any violations, the offense will fall off your record at the end of your probation sentence!

Did WalMart retain the stolen property as evidence? if so, at least you will not have to reimburse the store. Your main concern now is your conviction for shoplifting. The theory behind shoplifting is this: if a person steals something worth 49 cents, this same person will steal something worth a thousand dollars, if given the right opportunity. Like i said, shoplifting is a complex, serious charge.

Since this is your first offense, there is a good chance that you can get (what is called in NY) an ACD, which means that if you stay out of trouble for a certain period of time, this offense will be purged from your criminal history. Another commentator called this an SIS. Unless there are other circumstances, I don't see why you couldn't have this. "Shoplifting is a complex, serious charge." Not really. You'll pay a fine/restitution and put this in your past. Also, some states have statutes that permit the victim of shoplifting (i.e., Wal-Mart) to file a civil action against you to recover the amount of the item shoplifting -- even if you were caught and the item was returned to the store. Good luck - as a lawyer, I can tell you you'll be fine. Just don't do it again!
  • For future reference, be *VERY* careful for not getting caught shoplifting. A number of employers are starting not to go by convictions, but by your arrest record. Even if charges are dropped, an arrest record is still permanent and cannot be expunged because of the way it propagates to hundreds of privately owned databases. The reason employers are moving to arrest records is because of the feeling that people can get off for anything, and that is a police officer decides someone is guilty enough to slap cuffs on someone, they are guilty, period. Of course, employers are not going to state this, instead, anyone that has an arrest record, they just quietly trash the resume.

  • I can't believe the false feedback you are receiving, almost funny. For a first offense misdemeanor ask for a deferred adjudication, after a time period of lawful behavior it's not suppose to show up on your record. Many oppose this procedure and disagree but it is fact. Pay the fine and avoid probation, it's far from free. Expect a letter from the Walmart legal team asking for 3 times the amount for restitution. Pay that off or it will show up on your credit report. They usually have you sign something saying you understand that if you enter the store again you are committing criminal trespass, which in most cases they'll waive after 12 months with a written request.
