I'm rolling my 401k over to an individual IRA. If I withdraw the after tax contributions to the 401k without rolling them over, are they still subject to the 10% early withdrawal penalty?

You are able to remove the after tax contributions without penalty. However, if you remove any of the earnings on the after tax contributions these earnings are subject to taxation and penalty. -
