She needs to get her product patented first and then she can sell without taking the risk of getting robed because its already been registered under her name. i hope this helps.

she certainly needs to get it patented and paid for her discovery. her recipe is valuable. she needs to do trials on other people also.
-
First of all, she needs to file a patent. In this way she cannot be easily cheated out of any profits. Second, the product needs to be tested for efficacy following the standard protocols for prescription drugs. If this is not a prescription drug, she still should undergo testing to show that the drug works - otherwise the FDA will not back it (here in the US). Finally, if the product is shown to be efficaceous, she probably needs to partner with a drug company to produce, distribute, and market the drug. She'd probably need such a partnership for step 2, also. Again, the first step is the patent. Best of luck!

Step One: Get her to write the formula down and mail it to herself via registered mail (so it is signed and dated) and never open the envelope. Voila! Proof of date of idea with no external human intervention. (Any reasons why this would not work? I'd like to know.) Then go about getting a patent. If it all goes haywire, be prepared to tell the world so it is impossible for anyone else can get a patent. Sorry I can't be more helpful. Good luck.

Well, I agree that it must be doucmented, pictures must be taken, also, you must be sure to put some type of legal restirction on others useing it.

Before going to patent bureau with the documentation, put in the envelopes all the copies from the documents that you send to bureau and mail them to yourself. When you receive your letter back, do not open it - keep it just in case. If any court battle happens, you will have a legal proof of date made by a post office on the envelope. Whoever registers your product later than that date will lose.
