My husband and I got married 5 months ago and we just found out that his previous divorce is not final. Should we get ours annuled and get married again?

    I think most states would take the stance that there's no marriage to annul. Since his divorce was not final, your marriage would have no legal standing.

    Since the laws concerning both annulment and bigamy vary from state to state, you should probably consult a lawyer for advice about how to handle the situation as easily as possible.

    Touchy grounds here. you can only be married to one person at a time. if you are married to two people, at one time, its called bigamy. this is a crime in most states and fully enforceable. hope the other woman does not know this. it could be used against your husband. remember, records are public. anyone can check this out. i would have an annulment. it would show you both had good intent, once this new information was discovered.

    You probably don't need to get it annulled because you marriage is probably invalid due to the fact of his not being divorced in the first place.
