SR22 insurance forms are often required when a driver has been involved in a serious traffic incident or citation. Each state has different rules for the duration for which an SR22 form must be filed in order for an individual to maintain driving privileges.

Definition

The SR22 is also known as a Certificate of Responsibility. It is court-ordered by the state, and verifies the driver has current auto liability insurance. It is typically imposed after a major traffic infraction, such as driving under the influence, an accident where the responsible party had no insurance coverage, or had many citations in a short time period.

Duration

The duration of the necessary SR22 coverage is determined by the state in which the judgment occurred. In most states, the duration is typically set at three years. Based on the severity of the infraction and the state's law, an SR22 may be maintained for a longer time period.

Process

After a judgment has been made, the driver's license may be suspended until an SR22 is obtained from a state-authorized insurance agency. Once the filing has been made, the insurance company forwards the documentation to the state, and the state releases the driver's license.

Judgment

Some states allow a judge to determine the duration of the SR22 judgment. Delaware, Kentucky, Minnesota, New Mexico, Oklahoma and Pennsylvania do not require an SR22 filing.

Residency

If an SR22 is incurred in one state and the driver moves to another state, the driver cannot avoid carrying SR22 insurance. The SR22 must be carried until the driver's previous state releases the judgment.
