  • This depends on whether your surgery was covered under your insurance plan. You are the one obligated to pay the hospital. Your insurance is merely an indemnity provider, if the procedure was covered. Thus, the buck stops with you. If your insurance policy covers the procedure, but they refused to pay, then they can be sued for breach of contract (and possibly bad faith).
  • Get a lawyer and protect that letter because you'll need it as evidence. Let the lawyer do the talking. Do your research and get a good lawyer.
