  • As always, it's up to the judge. If all the agreements have been signed and filed to their satisfaction, they may just sign off on it. They may choose to continue the hearing to give the other party a chance to appear. What they're not likely to do is modify the agreement in ANY way. My ex didn't show. She wanted the court to restore her maiden name, but it was nowhere in the filings. The judge signed off on the paper work *as written*, and said she'd have to petition the court in a different motion for her name change.
