You seem to be assuming that hemp is synonymous with marijuana. Hemp fiber has been used for centuries in the same way that flax, cotton, and other vegetable fibers are used.

You can own things made from hemp, its cultivation is just restricted. Think hemp cord, hemp fabric, etc.

I think the Declaration of Independence is covered by the Constitution's prohibition of ex-post-facto laws.
