if you own any property, i think its a good idea to have a will. it can be difficult for loved ones to sort through possessions if you die intestate (without a legal will). in addition to minimizing emotional trauma of sifting through someones lifetime of possessions ~ a daunting, potentially overwhelming task ~ if you have many possessions, a will would minimize possible squabbling between family members over petty matters.
a living trust is even better than a will if you own property in order to avoid probate and minimize estate taxes. probate can tie up property in courts for years and its expensive. a trust is a legal arrangement by which a trustee holds legal title to property for someone else (the "beneficiary"). you can be the trustee of your own living trust, retaining full control over all property held in trust. i would talk to an attorney if you want to go that route.
If you own anything, especially real property and cash, you should have a will. If you have a spouse who isn't the parent of your children you need a will. If you everything you own is owned jointly a will is not as important. However, siblings will argue over a piece of furniture. So, better to have a simple will than to have nothing. Otherwise you let the state intestacy laws determine who gets your estate.
Yes, if you have any possessions you care about, if you have relatives or friends that depend on you, especially if you have children, if you care about what your loved ones will go through if you die, you should have a will or some sort of trust for them

Currently, 2011, do you need to have a small estate affidavit notarized in Illinois? I think this may have been a recent change.

My late wife and I had a trust for our kids. I removed all the monies and paid for my kid's college. Can my kid's come after me?
