  • You should argue that you ran the "yellow." Mitigating circumstances being the snow. Howwwwwwwwwwwwever, the judge has every authority to make an expample out of you (most likely) since running a yellow during snow is something they want to discourage. This is an answer as it relates to my jurisdiction not yours. Please look up on the internet the laws of your own jurisdiction for more specific information. Legal questions cannot really be answered her on A.B. when you don't say what jurisdiction you're from. Traffic laws differ from place to place.

  • Under the snow conditions you have described, ultra extra precaution is absolutely necessary. some people actually run a solid red light, in snow, in order to avoid having to stop and start again and being stuck. was this the case? In extreme weather conditions, the police are very tight on traffic law enforcement. this is to ensure the possibility of stopping an accident, before it occurs. Due to the conditions you have described, i probably would have issued you a citation.
  • I would say it can go either way and is worth fighting. Were you already turning when it was still yellow? I see people always do that, even turn on a red without stopping. If I were you I would fight it. If you have a picture of the intersection with the same conditions you faced, and it can help you explain your case, then that would work well. Be realistic, be optimistic, but don't be suprised if the ticket stands. Good Luck
  • I think so. A citation is more of an indictment than an actual verdict. The officer has reason to believe that you MAY have committed a violation. If you agree that you did in fact violate the law, pay the fine; that is like pleading guilty only without appearing in court. If you believe that there were mitigating factors, then the case should go to a judge. Personally, I would excuse that instance, and if you explain it well, the judge may too. Good luck :)
