  • In CA, if you are receiving your mail at the location you lay your head at night...then it is considered your Legal Residence. Start by writing them each a Letter of 30 day notice. (Unlawful Detainer) Since you have no written agreement their residency is considered a month to month (30day) rental. Keep a copy of each letter for YOUR file, give them 30 days to move out. (IF they begin to cause problems with behaviors during the 30 days, you CAN call the police...not for snide remarks, but for verbal or physical threats, theft of or destruction of your property.) MAKE SURE that you MAIL THEM each their letters and send them CERTIFIED, RETURN RECEIPT REQUESTED..you want a tracking number and you want them to have to sign for the letters, even if they have to go to the post office to pick them up (DON'T YOU sign for them!) Of course, another trick, (although the above should solve your problem...and get you what you want most!) is to sent them each letters INCREASING the rent (also after 30 days from the date received)...you have no written agreement, therefore, you might raise the rent to an amount more fitting for the situation. If they do not pay the rental increase, you assuredly can evict them. And at that point you issue a 3-day or Quit notice...they then need to be out in THREE DAYS. Worst case event is that you send them the 30-day notice to vacate...they don't...and then you make a call to your local Landlord/Tenant hotline, or your local representative...to find out where to find out your local laws...you MAY have the right (or not) to simply THEN change the locks, and put their personal stuff OUTSIDE...or....file a court case in Small Claims Court...nominal fee for this, no attorney, just YOU and the undesired roomies. As long as you have sent your letters, given them the 30 days, and created a paper trail as I've suggested...You should win. I'm a landlord in CA (San Diego) and was born and raised there, although I moved to PA in 2000. You can also speak with an Attorney FOR FREE...as in get a consultation...for about 20 to 30 minutes typically...I doubt they would urge you to sign up with them...no real $$ in it for them...and it is really a Small Claims deal at best.
