  • You may have to sue them. It depends on how much sick pay you are owed. A lawyer will probably take 1/3 of whatever you are awarded if you win the lawsuit. So if you're not talking about tons of money, it may not be worth the trouble to sue. You can probably call a lawyer and state your problem and the amount of money you are owed and ask if you should proceed with a lawsuit. For free. A good lawyer won't ask you to come in and pay an hourly fee just to answer your simple question "is it worth it?"
  • Nowadays you can sue for just about anything, but why would you want to put yourself and the company (that just went under) through more stress. Trying to get money out an already bad situation is never good.
  • Of course not. A company never has to pay you for unused sick days. And even if they did, they most likely would not have to because of the bankruptcy. A lawyer would never sue a bankrupt company on behalf of an unsecured creditor. Even if you won, you would never get paid. The purpose of bankruptcy is to eliminate debt.
