  • You need to see a lawyer and investigate filing a paternity suit. You have to prove the child is yours and not someone else's through a DNA test. Just because she said the child is yours doesn't mean that she didn't have sex with someone else and conceive the child. If the child is yours, then you have to petition the court for custody and be prepared for a legal battle. You might have to show that her home for the child is "unfit" and you definitely will have to show that the best interest of the child is to live with you. This is an uphill battle; be prepared to spend a lot of money and to hire an attorney that is specializes in Family Law. Contact your state or local bar association for the names of attorneys. If you are indigent, Legal Aid might help you, or there are lawyers who do pro bono (free) work as a service to the bar association.
