In my recipes a fruit tart would have a pastry base and the fruit flan would have a sponge base. Then of course, there's the fruit pie which is a tart with a lid on ;0)

The crust. A tart has a crust of some sort, and less custard. The flan is just the custard and some fruit.

A fruit tart consists of a loose custard (pastry cream) that in piped or poured into a pre baked tart shell with fruit on top. A flan is a firm custard that has fruit into it is poured into a mold, baked in a water bath or steamed. Flan is then inverted onto a plate. Flan can stand on it's own on a plate. There are less egg yolks in the pastry cream that is used in the fruit tarts. Flan has almost twice the amount of yolks compared to pastry cream.
