  • I belive it does. At least in my hometown being past curfew is an arrestable offense. If you are arrested they are allowed to search your person.

  • Let's first bring light to the rights one has, in that the laws are mandated to all citizens, and not just for those to whom are responsible for their actions, AND for themselves. Meaning that your use of "teenager" really isn't a true representation of the given situation. I will refer you to using a more correct termonology of "MINOR" in such cases of cerfew violation, as well as in where non-violent cases should be reffered to in the future. It may seem non-important to stipulate such facts, but it truly is important, in that if one is 18 or over, then they're considered an ADULT by law. You see, even though Minors arn't looked upon as responsible for their actions like an adult, they are however, after being caught in violation of law, still required to any search or "FRISKING" proceedures when taken into Police custody. These are protective measures, and will apply for all citizen regardless of age. OK, you see the difference now? To summerize, anyone 18 and 19 are certainly not minors anymore, but yes, they deffinitely are teenagers, and even though they are still considered teenagers by society, they deffinitely are not by the law. So, any such adult will not be applicable to your given scenario of cerfew situations, as they are responsibility for their actions unlike the minor, where it comes liable to their parents, where non- violent, or non-aggervated cases are concerned Whew! Now, with all that legalese out of the way, we can go on to the meat of your question. If there is a cerfew in one's area, and you are under 18, then YES the police do have the right to search you. This is because if one is out after the cerfew then they are in violation of a lawful ordinance and/or law, and as such, just as anyone to whom has broken a law, the police has a right to search you. So, if one happens to be a minor, and even if one hasent done anything wrong in their eyes of breaking any laws, truly due to the ordinance violation, truly, they still have. Because, just the fact that one is out during those cerfew restricted hours puts them in a violation of the law catagory! It comes fair and reasonable to be searched, and one will be searched without any rights violations unto them, just as any person will be, at any age after committing any crime, when taken into Police custody.   • I would think but im 17 and ive been out past curfew for years with friends. Ive drove past cops and they didnt care at 3 am. Never searched me since i was 14.

  • Yes. being past curfew, is a law violation in itself. therefore, this gives the police the right to search individuals, violating this law. A citation is an arrest. it is not a physical arrest, but it gives the police the authority to search a person for weapons or contraband.
