Not necessarily. You said that he "just discovered" that the ex's period is late. There was really no fraud at the time of your marriage if that's the case. You don't say it explicitly but a) I'm assuming you're thinking the late period means she's pregnant and b) that your husband is the sex partner she had to get pregnant. There's also the question of paternity if she's had more than one sex partner. Sounds like you need to get some more information to know how to proceed.

The statute is kinda vague regarding what exactly constitutes fraud, but it does say if you continued to live with the other person after you found out about the fraud then you can't use it as a reason. It also sounds like the fraud had to trick you into marrying him. § 6.107. FRAUD, DURESS, OR FORCE. The court may grant an annulment of a marriage to a party to the marriage if: (1) the other party used fraud, duress, or force to induce the petitioner to enter into the marriage; and (2) the petitioner has not voluntarily cohabited with the other party since learning of the fraud or since being released from the duress or force.

WHAT ? He's not denying the baby is his ? If you guys just got married , and she is 2 months late . Then how long was your engagement ? Look at the math here honey . Either you guys met and married , or he's been fooling around on you .
