I believe in life but I also believe woman should have a choice. If it was illegal, it shouldn't carry a sentence. I agree with Anonymous31, abby has super sneaky ninja skilz, and PeterODB.

It would depend on the basis for which it was made illegal. Assuming it were made illegal on the basis that the developing child was considered a life, then the case would be tried as a murder or manslaughter. Likely it would be a harsher sentence for the person performing the abortion than the woman having it... especially if it were a licensed doctor, he or she would likely be risking their license in addition to the other legal consequences.

im very pro-choice. if abortion were illegal, then the althernative should be mandatory birth control by another method (e.g. pills). i dont like your use of the word "sentencing" in this hypothetical question. the tone is nasty.

If it was considered murder, they should get the charges that murderers get, if it is a misdemeanor, I would suggest that they do community service in a child day care center or an abortion clinic.

The Doctor would probably get felony assault and battery and the woman would get, a sort of misdemeanor. My opinion is that it should be murder but, until the courts and science agree to the classification of the unborn as a person rather than a fetus, there will be no murder charge available since the child is not yet considered a person. Sad but true.

IF abortion was illegal (and I don't think it should be), a woman should be sentenced to counseling and probation. There's no reason to put her in jail -- she's probably going through tough times, which could be considered punishment enough.

If someone were to kill a pregnant woman they would be charged with double murder. So the person performing an abortion should also be charged with murder. The mother should be charged with assistance to a murder.

There may be very good reasons for the abortion. In particular, certain serious medical conditions can be exacerbated by pregnancy.

Well I don't think it should be completely illegal. There should be special circumstances where they are allowed. Anyway to answer the question if it were illegal I think the women and doctors should be charged with murder except in special circumstances (Example: incest) then the women should only have to under go counseling.

Unless it was determined a life-threatening necessity, it is the "pre-meditated" taking of a human being's life. Definition of human being: (human): "that of pertaining to man or mankind" (being):"that which exists in any form". Human being: pertaining to mankind in ANY form. Baby: "unborn or recently born person" Conscience: :the moral faculty passing judgement on one's self: the inward principle of character that determines ones actions, purposes, and values." You can make abortion legally right but you won't make it morally right. WE were brought up to believe it is wrong to take an innocent human being's life, and to do it with pre-knowledge is pre-meditated murder. Our conscience is both personal and social and inter-related. We know the differences between right and wrong. When that "line" becomes "fuzzy" confusion, social unrest, and conflict arises. I have a conscience and I think killing an innocent human being is murder. Anyone else?

Well, I'll start off by saying that I don't agree with making abortion illegal, so I disagree with any punishment imposed. However, if there was sentecing for the woman who had the abortion then I think the man who impregnated her in the first place should also serve. Birth control is both parties responsibilty and no woman ever had an unplanned pregnancy without a man. I always find it funny when guys say something like, "I don't care what others do, but no one better abort MY baby." Then wrap it up, sonny, because preventing the situation is equally your responsibility.
