  • If you two are not married, the biological father can file for joint custody. but, with his background and pending drug cases, it appears he is fighting a losing battle for custody. The courts frown on unfit parents who are ciminals or drug addicts. many children have been placed in foster homes, because of this situation. You should have no problem, but i would seek the advice of an attorney, where you live, just to be there, if needed.
  • Despite what we all know about unfit parents, the courts are reluctant to eliminate a parent from a child's life without first giving visitation a chance. That court may grant your baby's father supervised visitation. (This was the case with a friend of mine who adopted her nephew from her brother and druggie girlfriend. They gave the druggie way too many chances to do right by the child before terminating her parental rights.) Document your case well and make sure you are doing everything you can to demonstrate that you will provide a safe, loving and stable environment for your child.
  • Custody, probably not, visitation, yes, and maybe with stipulations (going to rehab, taking UA's) He can though, if he does everything the courts ask him to, try for some kind of joint custody.
