Help answer this question below.

We filed bankruptcy in 2001, due to economic conditions, etc, we probably need to file again, however, the eight years will not be up until February of 2009. We are about to lose our car, behind on mortage payments, etc.

    I think you can file every 7 years.. that's the way it used to be unless it's recently changed. Wouldn't hurt to contact a lawyer and see.
