  • If it were just the carpet, probably not and the most you could get from even the most sympathetic judge would be an abatement. But black mold is a major health risk and if it hasn't been remedied (if there's a leak that hasn't been fixed, for example) you can probably get out of the lease if you follow the proper process. File suit with your municipal court and be prepared to show evidence that the black mold was not remedied correctly and that the apartment was not prepared for occupancy.
