  • In my state (NH) my insurance company would cover the accident regardless of who was driving. Then again, my insurance is on my car. Actually, my policy would cover a vehicle I rent and I believe liability in a vehicle I borrow but not collision on the vehicle I borrow itself but those I caused damage to other than that vehicle. Your brother needs to have a conversation with his insurance company.
  • In CA you totally can - there are limits to other drivers on policies however - if you live with your brother the insurance company will either ask him to add you to his policy or exclude you (which means no coverage if you drive the car). Depending on the state insurance either follows the car or the driver - you should call a local agent and ask if your state is one where it follows the car. In that case you should be okay.
  • 2 things you have to have. 1 a valid license 2 your brothers permission to use the car, if yes to both then the ins. should cover damages
