I had same problem, just file the 'injured spouse' form and you will be ok

Yes, you're married to him so you are one legal entity! If you want to be considered separate then divorce him! You're like most people you want it both ways at the same time!

I'm not from the US so I can't really say. However you file seperately so I think would be a little unusual for them to tar you with the same brush. Probably even more unusual would be adding salad leaves, cocktail umbrellas or paprika to your wages though. I don't think they would do that.
