I do believe that you have to be served papers prior to the REPO the last of 3 is in person, that is generally 2 by mail and one in person at that time you are required to make payment or surrender the vehicle, this should be done in the presence of an officers of the court .. it protects both parties from unfounded accusations IF court appearances are required of course if you are stubborn enough to take it to that point you could be charged for the court cost as well as losing the vehicle .. ~Nemo~

i used to repo cars myself so i know how things like this work. the first answer said they think you have to be served papers before you get repoed..? not true in any state i know of. think about it.. if you know when your car is going to go for a ride without you some people may think about preventing that from happening besides making a payment, making matter worse. you will be charged if you assault the repo man for doing his job. the repo man wont harm you unless he is forced to defend himself from you. that i know of legally no one is allowed to defend a car from a human being with any type of physical force, thats what the cops are for. to end this..say for example... your in your car or you get in your car before the repo man hooks his truck up to yours then he cant do anything to get you out physically. all he can really do is talk to you and get you out or call the cops and sometimes they will make you get out of the car and he will take it away. but sometimes because you caused a scene and there was a breach of piece the cop will make the repo man drop your car and leave but be warned if this happens... your car will be be watched and next time you go shopping or get gas you might be walking back home. ive done it. hope this helps

The correct answer is no, it is not a crime not to pay your car payment. If the loan company could solve this problem through the legal system they would not need repo men. You have not commited a crime, you are liable civilly and they may write off the loan and leave you holding a car you cant sell and the mark against your credit. Dont listen to comments that say " you will be charged with grand theft auto" thats crap, there have to be certain elements for a crime to take place and not honoring you contract is not one. Most time these comments are posted by repo guys who have dropped out of high school and dont know there assholes from a hole in the wall. Logical thinking will guide you pay it up if you can and yes these guys are very good t what they do, but they are not GODS. they can only act on the information you provide either at the signing of the contract or when the repo man calls and scares you into telling where the car is.Do not apply for credit cards, do not forward you mail and communicate with the people you listed as referneces and they will never find it. Screw them!!!

What if I keep the car garaged and never drive it? At what point can the bank get it? I'm laid off and just getting unemployment, when I'm back to work I will pay up the bank note, but don't want to lose the car before. What can they do? Am I stealing the car?

No but you can continue to incurr costs, fees and penalties for as long as you own !!!!! That car !!!!!!
